Comeback Software

Terms of Service

Effective November 3, 2026 · Comeback Software LLC · mail@comebacksoftware.com

Covers Find The RunFind The ConcertBucket and comebacksoftware.com. It replaces the separate terms those products had before.

The short version

Find The Run and Find The Concert are directories. We list races, run clubs and shows; we don't run them or sell the tickets, and the details come from organizers and public sources, so check before you go. Bucket is a list of places you want to go, shared with friends you choose.

Use them fairly, don't scrape them, be decent to other people, and understand that we provide everything "as is". Disputes go to arbitration or small claims court, and you can opt out of arbitration within 30 days of first agreeing. If you'd rather sort something out by email first, so would we.

1. The agreement

These Terms of Service are a contract between you and Comeback Software LLC, a California limited liability company ("Comeback Software", "we", "us"). They cover:

together "the products", and any emails, notifications, data feeds and features that go with them. By using any of them, creating an account, or tapping a button that says you agree, you accept these terms and our Privacy Policy, which explains how we handle your information. If you don't agree, please don't use the products.

Section 17 contains an arbitration agreement and class action waiver that affect how disputes are resolved. Please read it; it explains how to opt out.

2. Who can use our products

3. Accounts

Find The Run accounts are optional; Bucket requires one; Find The Concert has none. When you sign in with Apple, Google, Facebook, Strava, an email code or a phone number, you give us accurate information and keep it current. You are responsible for everything that happens under your account, so keep your sign-in secure and tell us right away at mail@comebacksoftware.com if you think someone else has used it. One person, one account; don't share accounts, don't make accounts for other people, and don't make a second account to get around a block or suspension. You can delete your account at any time, in the app or by email, as described in the Privacy Policy.

4. What each product is, and isn't

Find The Run

Find The Run helps you find running races and run clubs in the US and Canada. We do not organize races, sell entries, time results or run clubs. Register takes you to the race's own registration site, and your entry, its price, refunds and the race itself are between you and the organizer. Race and club details come from organizers, registration platforms, club pages and other public sources, and can be incomplete, out of date or wrong. Races move, change distance and get canceled. Weather is a forecast or an estimate. Always confirm with the race before you register, travel or show up.

Find The Concert

Find The Concert helps you find live music. We do not sell tickets, promote shows or control venues. Get Tickets takes you to Ticketmaster or another seller, and the purchase, its terms, fees and refunds are between you and that seller. Event details come from ticketing and public data feeds and can be wrong or change without our knowing; lineups change, shows sell out, move and cancel. Confirm with the seller or venue before you buy or travel.

Bucket

Bucket is a city-by-city list of places worth going, which you save, visit, rate and share with friends you choose. The places on a city's list are chosen by us and shaped by community votes. The list is never for sale: no place pays to be on it, and no place can pay to be taken off. Hours, prices, menus and whether a place still exists change constantly, so check before you go. We don't own, operate, vouch for or take responsibility for any place on the list, for your friends' plans, or for what happens when you go.

Early access

Some products or features are in beta or early access and are labeled that way. They may change, break or go away, and we may reset data in them. Please don't rely on a beta feature for anything important.

5. Rules

Use the products the way they are meant to be used. Don't:

We may remove content, limit features, suspend or close accounts, and report people to the authorities when we reasonably believe these rules or the law have been broken, with or without notice depending on how serious it is. We're not obliged to monitor everything, and we don't promise we'll catch everything.

6. Things you add

You keep what's yours. Races, clubs, course files, logos and song picks you add to Find The Run; the lists, notes, ratings, votes, plans, comments, photos and suggestions you add to Bucket; artist picks and alerts on Find The Concert; and messages you send us, are all "your content". We don't claim ownership of it.

The permission you give us. So we can run the products, you give us a worldwide, non-exclusive, royalty-free, sublicensable (to the providers who host and process it for us) license to host, store, copy, reformat, resize, crop, generate previews and illustrations from, analyze, display, distribute and otherwise use your content, as part of the products and to promote them, for as long as the product needs it. This means, for example: your Bucket photos are shown to your friends; your race submission is published for everyone; your votes and suggestions shape a city's list in aggregate; a race or club you submitted stays on the site after you delete your account; and a plan or list you created stays with the other people on it. We don't use your private notes, your photos or your friends' activity in advertising or on the public web.

What you promise. You have the rights needed to grant that license; your content is accurate as far as you know; it doesn't infringe anyone's rights or break these terms; and if your content includes other people (a photo of your friends, a contact's phone number), you have their permission to share it with us.

Feedback. If you send us ideas or suggestions about the products, we can use them without owing you anything.

Moderation. We may screen, edit, label, reject or remove content at any time, including with automated checks described in the Privacy Policy, and we may keep records of removed content and of reports for moderation purposes.

7. Bucket: friends, contacts, photos and plans

8. Find The Run: organizers and featured listings

9. Other people's content, links and affiliate links

The products contain information from organizers, registration platforms, ticketing feeds, venues, clubs, Google, Spotify, Instagram and other public sources, and they link to sites we don't control. We don't endorse those sites and aren't responsible for their content, accuracy, availability, products, prices, privacy practices or terms. When you leave for a registration site, ticket seller, Spotify, Amazon, the App Store or anywhere else, that site's terms apply.

Affiliate links. Some outbound links carry a referral code: registration links to RunSignUp and Race Roster, ticket links to Ticketmaster through Impact, and product links to Amazon (as an Amazon Associate, we earn from qualifying purchases). If you register, buy or subscribe after following one, the seller may pay us a commission at no extra cost to you. Affiliate relationships never change which races, clubs or shows we list or how we rank them.

Ads. The Find The Run website may show ads through an ad partner. An ad isn't our endorsement, and we're not responsible for what it leads to.

Maps and places data. Maps and place details come from Apple, Google, Mapbox and HERE and are subject to their terms, including Google's Maps terms where Google's data is shown.

AI-generated content. Bucket's illustrations and short place descriptions, and some run-club research on Find The Run, are generated with AI tools from the information we have. They can be wrong, and an illustration is an interpretation, not a photo. Don't rely on them for anything that matters.

10. Public data, API and automated access

Find The Run and Find The Concert publish public listing data through documented endpoints, including an API with issued keys and a public MCP endpoint for AI assistants. You may use them only as their documentation allows, with attribution to the product, within any rate limits, and not to build a competing directory, resell the data, or train a model on it. We can change, rate-limit, suspend or withdraw these endpoints at any time, and revoke a key for misuse. Any other automated access to the products (crawling, scraping, headless browsing, bulk downloads) is not allowed without our written permission, except that search engines may index our public pages as our robots rules allow.

11. Our content and trademarks

The products, their design, code, writing, curated lists, illustrations, logos and names (Comeback Software, Find The Run, Find The Concert, Bucket, and the hummingbird) belong to Comeback Software or our licensors and are protected by copyright, trademark and other laws. We give you a limited, personal, non-exclusive, non-transferable, revocable permission to use the products for your own non-commercial purposes under these terms, and nothing else. Facts about races, shows and places are facts and aren't ours; the way we select, describe, arrange and illustrate them is. Don't use our names or logos to suggest we endorse you, and don't remove any notices from our content.

We respect intellectual property and take down infringing material. If you believe content on one of our products infringes your copyright, send a notice under the Digital Millennium Copyright Act to mail@comebacksoftware.com with the subject "DMCA", including:

  1. your physical or electronic signature;
  2. identification of the copyrighted work you say is infringed;
  3. the URL or location of the material you want removed, with enough detail for us to find it;
  4. your name, address, telephone number and email address;
  5. a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law;
  6. a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act for them.

We'll remove or disable access to the material, tell the person who posted it, and accept a counter-notice from them that meets the DMCA's requirements. We close the accounts of repeat infringers. Knowingly sending a false notice or counter-notice can make you liable for damages.

13. The apps and the App Store

These terms also apply to the Find The Run and Bucket iOS apps. We license the apps to you; we don't sell them. The license is personal, non-transferable, revocable, and lets you install and use each app on Apple devices you own or control, under the App Store's usage rules. Don't copy, modify, reverse-engineer or redistribute the apps except as the law allows.

Because the apps come from Apple's App Store, the following also applies:

The apps may update themselves automatically, including through over-the-air updates, and may require a minimum version to keep working. Push notifications, location, contacts, photos and calendar access are each optional and controlled in iOS settings.

14. No warranties, and real-world risk

The products are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage. We don't promise that the products will be accurate, complete, current, uninterrupted, secure or error-free, that listings reflect reality, that a race, show or place will happen or be open, that any content will be preserved, or that defects will be fixed.

Real life has risk, and that's yours. Running, racing, going to shows, traveling, and visiting places you found on an app all carry risk of injury, illness, loss and worse. You decide what's safe for you: train sensibly, see a doctor when in doubt, follow the organizer's, venue's and local rules, and look after yourself and the people with you. We aren't responsible for the events, venues, places or people the products point you to, for what happens there, for travel or lodging costs, or for race fees or tickets you buy from anyone.

Some places don't allow some of these disclaimers, so they apply to you only as far as the law allows.

15. Limits on our liability

To the fullest extent the law allows:

These limits are a basis of the bargain between us, and apply even if a remedy fails of its essential purpose. They don't limit liability that can't be limited by law, including for our fraud, gross negligence, or willful misconduct, or for death or personal injury caused by our negligence where the law doesn't allow that to be limited.

16. Your responsibility for your use

If a third party makes a claim against us because of your content, your use of the products, your breach of these terms or of the law, or your violation of someone else's rights, you agree to defend us, pay any resulting damages, costs and reasonable attorneys' fees, and cooperate with us. We may take over the defense of any claim at our expense, in which case you'll cooperate with us; you won't settle a claim that binds us without our written consent.

17. Disputes: arbitration, class waiver, opt-out

Please read this section carefully. It affects your rights.

Talk to us first

Before starting any formal proceeding, you agree to email mail@comebacksoftware.com with your name, the product, what happened and what you'd like us to do, and to give us 60 days to work it out with you. We'll do the same before bringing a claim against you. Most problems get solved here.

Binding arbitration

If we can't resolve it informally, any dispute, claim or controversy arising out of or relating to the products, your content, these terms, or the Privacy Policy, including whether a dispute must be arbitrated, will be resolved by binding individual arbitration, not in court. The arbitration will be run by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, available at adr.org, as modified here. The Federal Arbitration Act governs this section. Hearings will be by video or phone, or, if an in-person hearing is needed, in the county where you live or San Francisco County, California, as the rules provide. The arbitrator can award the same individual relief a court could, must follow these terms and applicable law, and will issue a short written decision. We'll pay the filing and arbitrator fees for any claim you bring in good faith where the AAA rules put them on the consumer, and in any case where your claim is for $10,000 or less, unless the arbitrator finds the claim frivolous.

Exceptions

Either of us may instead bring an individual claim in small claims court if it qualifies there, and either of us may seek an injunction or other equitable relief in court to protect intellectual property or stop unauthorized access or scraping. You may also bring a complaint to a government agency, which this section doesn't prevent.

No class actions

You and we agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. The arbitrator may not consolidate claims of different people or preside over any form of representative proceeding. If this class waiver is found unenforceable for a particular claim, that claim (and only that claim) will be heard in court, and the rest of this section still applies to everything else.

Opt-out

You can reject this arbitration agreement by emailing mail@comebacksoftware.com with the subject "Arbitration opt-out", your name, and the email or username on your account, within 30 days of the first time you agree to these terms (or within 30 days of November 3, 2026 if you were already a user). If you opt out, the rest of these terms, including the governing law and venue below, still apply, and your opt-out doesn't affect any earlier arbitration agreement you may have accepted.

Governing law and venue

California law governs these terms and any dispute, without regard to its conflict-of-law rules, except that the Federal Arbitration Act governs section 17. For anything that goes to court, you and we agree to the exclusive jurisdiction of the state and federal courts in San Francisco County, California, and waive any objection to that venue, except that either of us may bring a qualifying claim in your local small claims court. Nothing here takes away protections you have under the mandatory consumer laws of the place you live.

Time limit

To the extent the law allows, any claim must be brought within one year after it arose, or it is permanently barred.

18. Ending things

You can stop using the products at any time and delete your account in the app or by email. We can suspend or end your access to any product, or any feature, at any time, with notice where reasonable, if you break these terms, if we must by law, if your use creates risk or legal exposure for us, or if we discontinue the product. If we close your account for a reason other than your breach, you can ask us for a copy of your content first, as the Privacy Policy describes. Sections that by their nature should survive (6, 9 through 12, 14 through 17, 20) survive termination.

19. Changes to the products and these terms

The products change. We add, change and remove features, listings, cities, sources and integrations, and we may stop a product entirely. We'll try to give notice for anything significant, and we'll never charge you for something you didn't agree to.

We may change these terms too. When we do, we'll update the effective date at the top. If a change materially affects your rights, we'll tell you at least 14 days before it takes effect, by email, in the product, or by a notice on this page, and you can reject it by stopping use and deleting your account before then. Using the products after a change takes effect means you accept it. Changes to section 17 don't apply to disputes that began before the change.
